All Things AI, Inc Terms and Conditions

1. Eligibility

You must be at least 13 years old to use the Services, except that a child under 13 may use the Form Coach app when a parent or legal guardian sets it up and accepts these Terms on the child's behalf as described in Section 3A.6. If you are under 18, you represent you have permission from a parent or guardian.

2. IMPORTANT: Not Medical Advice

Our products are for informational and educational purposes only. Nothing in the Services constitutes medical advice, diagnosis, treatment, or a substitute for professional care.

You agree that:

• You will not rely on our Services as medical advice
• You will consult qualified professionals for health decisions
• You are solely responsible for your choices and outcomes

3. IMPORTANT: Exercise, Fitness, and Physical Activity — Assumption of Risk

Some of our Services (including Form Coach and other fitness-related apps) provide exercise demonstrations, movement tracking, rep counting, form feedback, workout suggestions, and reminders. Physical exercise carries inherent risks, including the risk of muscle strain, sprains, falls, cardiovascular events, aggravation of existing conditions, and other bodily injury, up to and including serious injury or death.

By using any fitness-related Service, you acknowledge and agree that:

• You exercise entirely at your own risk. You voluntarily assume all risks associated with physical activity performed while using, or based on, the Services.
• Consult a professional first. You should consult a physician or qualified healthcare provider before beginning any exercise program, especially if you are pregnant, elderly, have a heart condition, high blood pressure, joint or bone problems, a history of injury, or any other medical condition.
• Choose exercises suitable for you. You are solely responsible for selecting exercises, intensity, duration, and equipment appropriate for your age, fitness level, health status, and medical conditions, and for exercising reasonable caution at all times (including proper warm-up, safe surroundings, sturdy equipment, and hydration).
• Stop if something is wrong. Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptom.
• Camera guidance is approximate. Rep counts, form scores, and feedback are generated by automated on-device analysis and may be inaccurate. They are informational only and are not a substitute for supervision by a qualified trainer or medical professional.
• We are not responsible for injuries. To the maximum extent permitted by law, All Things AI, Inc is not liable for any bodily injury, health complication, property damage, or death arising from or related to exercise or physical activity you perform in connection with the Services.

3A. Form Coach — Assumption of Risk, Release, and Waiver

This Section 3A applies to the Form Coach app on iPhone, iPad, Apple Watch, and Android, and supplements Section 3. Before Form Coach can be used, every user must read an in-app safety and responsibility notice and affirmatively accept it. That acceptance is a binding agreement to this Section 3A and to these Terms. If you do not accept, the app cannot be used.

3A.1 What Form Coach is. Form Coach is a software tool. It is not a personal trainer, coach, physical therapist, physician, or medical device, and it does not supervise you. It uses your device's camera and automated software to draw exercise figures, give instructions, count repetitions, score form, speak cues, and suggest exercises and routines. Everything it shows or says is generated automatically, on a best-effort basis, without human review. It can be wrong, incomplete, delayed, or unsuitable for you, your body, your equipment, or your surroundings.

3A.2 Your own care and judgment. You agree to exercise your own due diligence, care, and judgment at all times when exercising with AI guidance. You will not rely on Form Coach as a substitute for professional instruction or medical advice. You will stop exercising immediately and seek medical attention if you feel pain, dizziness, chest discomfort, shortness of breath, or anything unusual. You alone are responsible for deciding whether an exercise, intensity, duration, tempo, surface, space, or piece of equipment is safe for you, and for warming up, hydrating, and keeping your surroundings clear.

3A.3 Medical clearance. You represent that you have consulted, or had the opportunity to consult, a physician or qualified healthcare provider before beginning any exercise program with Form Coach, and that you will do so before continuing if you are pregnant, have a heart condition, high blood pressure, a joint, bone, or balance problem, a history of injury, or any other medical condition.

3A.4 Voluntary assumption of risk. You understand that physical exercise carries inherent risks, including but not limited to muscle strain, sprains, fractures, falls, cardiovascular events, aggravation of existing conditions, and other bodily injury, up to and including serious injury, permanent disability, or death. You knowingly and voluntarily assume all of these risks, whether or not they are listed here, including risks that arise from inaccurate, incomplete, or unsuitable AI guidance, from your misunderstanding or misapplication of that guidance, and from your surroundings and equipment.

3A.5 Release, waiver, and covenant not to sue. To the fullest extent permitted by applicable law, you, on behalf of yourself and your heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue All Things AI, Inc and its officers, directors, employees, contractors, agents, licensors, and affiliates (the "Released Parties") from and against any and all claims, demands, causes of action, damages, losses, costs, and liabilities of any kind, whether known or unknown, arising from or in any way related to your use of Form Coach or any exercise or physical activity you perform with it, including claims for personal injury, illness, disability, property damage, or wrongful death, and including claims based on the negligence of a Released Party, and whether or not the app's guidance was accurate. You agree to indemnify and hold the Released Parties harmless from any such claim brought by or on behalf of you.

3A.6 Minors, parents, and guardians. Form Coach asks for a birth month and year before use and keeps only the resulting age group on the device. (a) Ages 13 to 17: a parent or legal guardian must read the in-app notice with the minor and agree to it on the minor's behalf where the law allows, and the minor must confirm that they have; where local law requires a parent's consent for a young person's data, that agreement also gives it. (b) Under 13: a child may use Form Coach only after a parent or legal guardian completes the in-app parental check and accepts the notice and these Terms. (c) A parent or guardian who accepts on a minor's behalf agrees to these Terms, including this Section 3A, for themself and on behalf of the minor, to the fullest extent the law allows; agrees to supervise the minor's use and every exercise session; is responsible for choosing exercises, intensity, duration, equipment and a space suitable for the minor's age, size, development and health, and for keeping children away from weights, heavy resistance, high-impact or rehabilitation exercise without an adult's direct guidance; and acknowledges that Form Coach's rep counts, form scores and cues are tuned on adults and may be less accurate for children. (d) Some jurisdictions do not enforce a release signed by a parent for a minor's own claims; where that is the case, the release in Section 3A.5 applies to the parent's or guardian's own claims and to the fullest extent permitted, and the parent or guardian's agreement to supervise and to choose suitable exercise remains in effect. Nothing in these Terms, including Sections 3A.5 and 13, requires a parent or guardian to indemnify us against their child's own claims. (e) In a child's setup Form Coach does not send usage statistics, makes no ad-attribution lookups, never asks for an App Store rating, turns off friend features, leaderboards and sharing to social apps, and does not allow the child to publish routines; see the Form Coach privacy policy.

3A.7 Emergencies. Form Coach does not monitor for medical emergencies and cannot call for help. In an emergency, stop and contact your local emergency number.

3A.8 Scope and severability. This Section 3A is intended to be as broad and inclusive as the law of your jurisdiction permits. Some jurisdictions do not allow the exclusion or limitation of liability for death or personal injury caused by negligence, or of certain consumer rights; in those jurisdictions this Section applies to the fullest extent permitted and does not exclude liability that cannot lawfully be excluded. If any part of this Section is held invalid, the remainder continues in full force. The in-app notice is presented in several languages for convenience; the English text governs.

3A.9 Shared routines. Form Coach lets you share a routine you built through a link, and add routines other people share. (a) Not our content. A shared routine is written by the person who shared it, not by All Things AI, Inc. We do not write, review, verify, or endorse shared routines and are not responsible for whether a shared routine's exercises, targets, or instructions are safe or suitable for you. Before starting a shared routine, check every exercise and target yourself, and the assumption of risk and release in Sections 3A.4 and 3A.5 apply in full to shared routines. (b) If you share. You are responsible for the routines you share. Only share routines that are suitable for the people you send them to; do not include personal information about anyone (yours or others') in a routine's name, note or display name; do not share anything unlawful, harassing, hateful, sexual, misleading, spam or advertising, or routines that encourage dangerous activity. You grant All Things AI, Inc the license in Section 6 to host and display the routine to anyone with the link, and each person who adds it a non-exclusive, royalty-free license to keep, adapt and use their copy for personal exercise. (c) Links. A link can be opened by anyone who has it. You can turn a link off at any time; copies people already added stay on their devices. (d) Reports and removal. Anyone can report a shared routine from the app. We may remove or disable any shared routine or link at any time, and routines reported by several people are disabled automatically pending review. To report something urgently, email support@allthingsn.com. (e) Teachers, coaches, and organizations. If you share routines with students, clients or members, you are responsible for any supervision, consent, and safety obligations you owe them, including obtaining any parental consent your school or organization requires; Form Coach is a tool and does not supervise anyone.

4. AI Output Disclaimer

The Services may generate outputs using AI systems. AI outputs may be inaccurate, incomplete, misleading, or inappropriate.

You acknowledge:

• AI outputs are not guaranteed to be correct
• AI results may be reviewed by humans, who may or may not be dietitians
• You use AI outputs at your own risk

5. Dietitian and Geographic Limitations

PantryRx may offer access to one registered dietitian licensed in California. If any dietitian services are made available:

• They are limited to where legally permitted
• Users outside California may receive only general informational content
• We do not guarantee availability of dietitian services at any time

6. User Content and Permissions

You may upload content (photos, text, household details) ("User Content"). You retain ownership of your User Content as between you and All Things AI, Inc.

By uploading User Content, you grant All Things AI, Inc a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify (for formatting or processing), and display your User Content solely to:

• Operate and provide the Services
• Run AI analysis and generate outputs
• Improve quality, safety, and performance
• Provide customer support
• Comply with legal obligations

You represent that you have the rights to upload the User Content and that it does not violate law or third-party rights.

7. Prohibited Uses

You agree not to:

• Use the Services for unlawful purposes
• Attempt to hack, disrupt, or reverse engineer the Services (except where legally allowed)
• Upload malicious code or harmful content
• Misrepresent identity or impersonate others
• Use the Services to provide professional services without proper licensing

8. Third-Party Services and Links

The Services may reference third-party services and datasets (including USDA FoodData Central). We do not control and are not responsible for third-party content or services.

9. Intellectual Property

The Services and all related content, software, design, and branding are owned by or licensed to the Company and protected by intellectual property laws.

Trademark: All Things AI, Inc and its product names, including PantryRx, are trademarks or trademark applications of the Company. You may not use our marks without permission.

10. Termination

We may suspend or terminate your access at any time for any reason, including if we believe you violated these Terms or pose risk to the Services.

11. DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. LIMITATION OF LIABILITY (Very Important)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY (INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR ANY BODILY INJURY OR HEALTH COMPLICATION ARISING FROM PHYSICAL ACTIVITY, ARISING FROM OR RELATED TO:

• YOUR USE OR INABILITY TO USE THE SERVICES
• ANY AI OUTPUTS OR RECOMMENDATIONS
• ANY EXERCISE, WORKOUT, OR PHYSICAL ACTIVITY PERFORMED IN CONNECTION WITH THE SERVICES
• ANY HUMAN REVIEW OR SUPPORT INTERACTIONS
• ANY DECISIONS YOU MAKE BASED ON THE SERVICES

IF LIABILITY IS FOUND NOTWITHSTANDING THE ABOVE, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE SERVICES IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in such cases, limitations apply to the fullest extent permitted.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Company from any claims, damages, losses, and expenses (including attorneys' fees) arising from:

• Your use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any law or third-party rights

14. Governing Law; Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Exclusive venue for disputes shall be state or federal courts located in Delaware, unless otherwise required by applicable law. If you are a consumer in the European Union, the United Kingdom or Switzerland, you keep the protection of the mandatory consumer law of your country of residence and may bring proceedings in the courts there.

15. Changes to Terms

We may update these Terms at any time. The "Last Updated" date will change. Continued use after updates constitutes acceptance, except that for a Form Coach child's setup, a material change to Section 3A or to how a child's data is handled takes effect only after the parent or guardian accepts it in the app.
